Civil Rights Act in Michigan

Michigan's Elliott–Larsen Civil Rights Act (ELCRA), MCL 37.2101 et seq.,

 "(1) The opportunity to obtain employment, housing and other real estate, and the full and equal utilization of public accommodations, public service, and educational facilities without discrimination because of religion, race, color, national origin, age, sex, sexual orientation, gender identity or expression, height, weight, familial status, or marital status as prohibited by this act, is recognized and declared to be a civil right."     Plaintiff was an employee of General Motors.  She complained to her supervisor that male Indian employees did not like to work with women.  Her supervisor “confirmed to me that discrimination does exist; however, she told me GM will not do anything to the Indian contractors or resources.”
 
    Plaintiff came to a point where she could no longer endure the discrimination and told her supervisor she was going to Human Resources with her complaints.  Her supervisor “was very angry, red, turned red, and she told me that, again -- she told me again that GM will not take action against them...”.  A few days later her supervisor made up the reason as to why Plaintiff was going to be fired.
 
    General Motors admitted they “destroyed” the hard drive of the computer Plaintiff was working on at GM which contained the facts involving her being discriminated against.  Defense counsel admitted it was “[d]uring the period of time right before and right after.  Very close to the time that the demand letter was sent, but before the lawsuit was filed”.

    One witness stated “[t]here was an abusive attitude by the testers towards both women and people of the Islamic faith which created an abusive and hostile work environment.”  “The testers also made negative comments about [Plaintiff] wearing her religious headwear.”  Plaintiff was openly called “hummus” by the Indian GM workers and her supervisor was aware of that fact.
